国家监察委员会立法权的法治建构

The Rule of Law Construction of Legislative Power of National Supervisory Committee

作为2018年修宪时新增设的国家机关,国家监察委员会基于自身的宪法地位享有独立的立法权,以便为国家监察体制改革向纵深发展供给配套的监察法规。目前,尽管已经获得了监察法规制定权,但国家监察委员会的立法权在权力来源、内容范围以及监察法规的法律位阶、制定程序等方面仍存在规范层面上的缺失,并由此导致监察工作实践中的多重困境。有鉴于此,应当结合国家监察工作的实际需要,在宪法和法律的框架下,通过未来修改《中华人民共和国立法法》等措施对国家监察委员会的立法权进行法治构建,充实国家监察委员会立法权的内容,建立健全监察法规制定程序,以满足国家监察体制改革的规范供给与实践需求。

As a newly established state organ when the constitution was amended in 2018,the National Supervisory Committee enjoys independent legislative power based on its constitutional status,so as to provide supporting supervisory regulations for the further development of the national supervision system reform.At present,although it has obtained the supervision-regulations-making power,there exist still some normative defects in the source of power,scope of content,legal rank of supervision regulations and formulation procedures,which lead to multiple difficulties in the practice of supervision.In view of this,we should combine the actual needs of the national supervision work,under the framework of the Constitution Law and the laws,through the future amendment of the Legislative Law and other measures to build the legislative power of the National Supervisory Committee under the rule of law,enrich the legislative power of the National Supervisory Committee,and establish and improve the formulation process of supervisory regulations,so as to meet the normative supply and practical needs of the national supervision system reform.
