Review and Legislative Suggestions of laws and Regulations on the Protection of Chinese Historical and Cultural Features

文章以中国中央和地方颁布的历史文化风貌保护相关法律法规为研究对象,对现有保护法律法规进行综述,有利于进一步厘清历史文化风貌保护法律法规的构成体系和内在逻辑,为修改完善法律法规提供更为清晰的依凭。通过文本分析与比较研究发现,中国现有历史文化风貌保护法律法规数量众多、门类庞杂,地方在进行保护实践时针对性较弱,易模糊方向,实际操作难度较大。在此基础上对历史文化风貌保护提出立法建议,促进保护工作富有成效的开展,使其更具有解决实际问题的导向性、明晰性,更好地发挥法律法规的作用,并以此有效提升城市软实力。

This article takes the relevant laws and regulations on the protection of historical and cultural features promulgated by the central and local governments as the research object,and summarizes the existing protection laws and regulations,which is conducive to further clarifying the composition and internal logic of the laws and regulations on the protection of historical and cultural features,to provides a clearer basis in amending and improving laws and regulations.Through text analysis and comparative research,it is found that China’s existing laws and regulations on the protection of historical and cultural features are numerous and complex,and the local protection practices are weakly targeted,easy to blur the direction,and difficult to operate.On this basis,put forward legislative suggestions on the protection of historical and cultural features,and promote the development and effectiveness of protection work,make it more oriented and clear to solve practical problems,better play the role of laws and regulations,and effectively enhance the city’s soft power.
