中国儿童权利研究的逻辑紊乱及其调适——基于学术史的考察 被引量:2

The Logical Disorder and Adjustment in the Study of Chinese Children’s Rights--Based on the Study of Academic History

摘要 中国儿童权利研究受到中国权利理论、西方儿童权利理论和中国儿童权利保护实践三重背景因素的影响。三者分别发挥着思想基石、理论源泉和现实动力的作用。中国儿童权利理论发展缓慢,已明显滞后于当下儿童权利保护的现实需要。通过学术史的考察,可以发现中国儿童权利研究的逻辑紊乱:理论基调模糊、理论语境杂糅和理论功能虚置。鉴于中国儿童权利理论的发展需要和中国儿童权利保护的实践要求,中国儿童权利研究的进路调适应从强化儿童权利基础理论研究、突出儿童权利理论的现实回应能力以及勾连儿童权利与本土文化这三个方面着重展开。 The research on children’s rights in China is influenced by the three background factors of Chinese rights theories,western child rights theories and China’s child rights protection practices.The three play the roles of ideological cornerstone,theoretical source and realistic power respectively.The development of the theory of children’s rights in China has been slow,and it has obviously lagged behind the current needs of protection of children’s rights.Through the investigation of academic history,we can find the logical disorder of the study of Chinese children’s rights:the theoretical tone is vague,the theoretical context is mixed,and the theoretical function is empty.In view of the development needs of the theory of children’s rights in China and the practical requirements of the protection of children’s rights in China,the approach of the research on children’s rights in China should focus on the three aspects:strengthening the research on the basic theory of children’s rights,highlighting the realistic responsiveness of the theory of children’s rights,and linking children’s rights with local culture.
