Foreign-Related Rule of Law in a Modernizing Great Power

中国推动涉外法治的决策是现代化强国战略规划的重要部分。近代以来西方国家在现代化的过程中应用法治的一系列实践,雄辩地说明了法治格局对于国家壮大的重要意义,特别是法治格局的域外延伸,为国家提供了持续、稳定、健康走向现代化强国的重要保证,也成为国家软实力的重要标志。当中国在现代化强国的道路上不断迈进之时,就特别需要关注和强调法治,积极推进涉外工作的法治化。中国的涉外法治应当采取的立场,既包括维护自身核心利益的斗争范式,也包括倡导共同价值、推进互利共赢的合作范式。在这种时代背景下,中国国际法职业共同体有必要深入探讨能够使中国在现代化道路上顺利前进的适当模式,从而推进法治中国的不断提升,促进现代化强国目标的顺利实现。

China’s decision to promote foreign-related rule of lawis an important part of the strategy towards a modernized great power.In the process of modernization,Western states applied a series rule of law practices which eloquently explained the importance of rule of law path to the rising of a state.In particular,the extraterritorial extension of rule of lawhas provided an important guarantee for a state approaching a modern great power with continuity,stability,and healthy development.Rule of lawhas also become a key symbol of a state’s soft power.As China continues to advance on the road to a modern great power,it needs to emphasize rule of law,especially promote rule of lawin foreign-related works.The position that China’s foreign-related rule of law should adopt includes not only the paradigm of fighting to safeguard its core interests,but also the paradigm of advocating for common values,advancing mutual benefits and win-win cooperation.In this context,it is necessary for the Chinese community of international law profession to thoroughly explore the appropriate model that can enable China to advance smoothly on the road of modernization,so as to promote the continuous improvement of rule of lawand realize the goal of a modern great power.
