摘要
我国个人金融信息法律制度存在立法碎片化问题,主要成因在于忽视了个人金融信息的经济法属性,陷于传统公、私法解决思路的桎梏,未能从宏观层面对个人金融信息法律制度的构建进行把握。大数据使得个人金融信息更加碎片化,进一步加剧了个人金融信息法律制度体系化的难度。在梳理我国个人金融信息法律制度的立法碎片化问题及其成因的基础上,本文结合个人金融信息的特点以及保护与共享的实际需要,从经济法整体主义的视角重新构建个人金融信息法律制度,建议在宏观层面制定《个人金融信息保护法》,明确个人金融信息的有关基础概念、范围、原则、监管机构以及分类标准。微观层面制定不同金融场景内的具体部门规章,完善个人金融信息全生命周期不同环节的具体规则设计。
The legal system of personal financial information in China has the problem of legislative fragmentation.The main reason is that it ignores the Economic Law attribute of personal financial information, and it is shackled by traditional solutions such as public law and private law. In addition, it fails to focus on the construction of the legal system of personal financial information from the macro level. Big data makes personal financial information more fragmented, further aggravating the difficulty of the systematic construction of the legal system of personal financial information. This paper analyzes the problem of legislative fragmentation and the causes of the legal system of personal financial information in China from the perspective of Economic Law. And this paper reconstructs the legal system of personal financial information from the perspective of Economic Law holism based on the characteristics of personal financial information and the actual needs for protection and sharing. Moreover, Personal Financial Information Protection Law should be formulated at the macro level, and the basic concepts, scope, principles,regulatory authorities and classification standards of personal financial information should be determined. At the micro level, specific departmental regulations in different financial scenarios should be formulated, and the specific rule design of different links in the whole life cycle of personal financial information should be perfected.
