摘要
检察官业绩考核是对检察官办理案件和其他检察业务的质量、效率、效果等进行的考核评价,是加强检察管理、推进检察监督体系和监督能力现代化的重要举措。检察官业绩考核制度在实践中面临着考核范围不当、量化评价不准、结果运用不足等三重困境,严重制约了检察官业绩考核制度的激励作用。为进一步完善检察官业绩考核制度,应坚持问题导向,以工作职责为基础确定业绩考核范围,优化考核指标体系及其评价方式,建立适度量化的考核机制,并加大业绩考核结果的运用力度。
The performance assessment of prosecutors is an assessment of the quality,efficiency,and effectiveness of prosecutors'handling of cases and other procuratorial work.The performance assessment of prosecutors is an important measure to strengthen procuratorial management and promote the modernization of procuratorial supervision system and supervision capacity.The performance assessment of prosecutors is faced with the triple dilemma of improper assessment scope,inaccurate quantitative assessment and insufficient application of results in the implementation process,which seriously restricts the stimulating role of the procuratorial performance assessment system.In order to further improve the performance assessment system for procurators,we should adhere to the problem-oriented approach,determine the scope of performance assessment based on responsibilities,optimize the evaluation index system and its evaluation methods,establish appropriate and quantitative appraisal mechanisms,and increase the use of performance assessment results.
