中医药传统知识视域下古代经典名方的保护现状与对策研究

Researches on the Protection Status and Countermeasures of Classic Prescriptions from the Perspective of Tradition-al Chinese Medicine Knowledge

古代经典名方作为传统中医药知识的杰出代表,对于中医药传承创新发展具有重大的现实意义。当前古代经典名方的数据库保护并未充分体现其专业性,在法律法规保护和专利保护方面,也还有所欠缺。鉴于此,文章基于国际和国内传统医药知识的保护案例和现状,探讨经典名方保护的方法及策略,以期能够为中医药的数据库保护、专利保护和法律保护方面提供可资借鉴的参考,也为我国中医药传统知识保护提供微薄之力,为中医药文化的继承创新和开拓发展做出贡献。

As an outstanding representative of Traditional Chinese Medicine(TCM)knowledge,ancient classical TCM pre-scriptions have practical significance for the inheritance,innovation and development of TCM.The existed database protection of ancient classical TCM prescriptions does not fully reflect their professionalism,and there is also a lack of legal and patent protec-tion.Based on the cases and current situation of international and domestic traditional medical knowledge protection,the methods and strategies for the protection of ancient classical TCM prescriptions were explored to provide a valuable reference for the data-base,patent and legal protection of TCM,which can also contribute to the protection of traditional Chinese medicine knowledge in China,and help the inheritance,innovation and development of traditional Chinese medicine culture.
