On the Interactive Development of Administrative Emergency Legal System and Digital Technology

行政应急法制与数字技术交互式发展,是指行政应急法制与以大数据、人工智能、云计算、物联网、区块链和5G技术等为代表的数字技术进行交流互动和深度融合从而发生深度变革的新型法制形态。从规范层面而言,这一新型法制具有调整对象涵盖行政应急系统内部诸要素与数字技术相融合所形成的社会关系、发展过程是数字技术驱动下的动态演变过程、价值取向是实现行政应急的科技“善治”等特征。“科学、技术与社会”理论和现代风险社会理论可以作为交互式发展的理论基础。从实践观察,交互式发展主要表现在:行政应急主体智能化,大数据驱动下行政紧急权多中心化,数字技术嵌入行政应急的全过程。但数字技术也给行政应急主体、行政紧急权和行政应急过程带来了一定的挑战。为适应交互式发展这一趋势,并回应挑战,现行行政应急法制需要在完善数字技术影响下的行政应急主体制度,强化个人信息权在行政应急法律制度中的功能定位,健全全方位全周期应急治理的大数据监管制度等方面作出变革。

The interactive development of administrative emergency legal system and digital technology refers to a new form of legal system that undergoes deep transformation through communication,interaction,and deep integration with digital technologies represented by big data,artificial intelligence,cloud computing,the Internet of Things,blockchain,and 5G technology.From a normative perspective,this new legal system has the characteristics of adjusting the social relationships formed by the integration of various elements within the administrative emergency system and digital technology,the dynamic evolution process driven by digital technology,and the value orientation of achieving scientific and technological"good governance"in administrative emergency.The theory of"science,technology,and society"and modern risk society theory can serve as the theoretical basis for interactive development.From practical observation,interactive development is mainly manifested in the intelligence of administrative emergency subjects,the multi centralization of administrative emergency powers driven by big data,and the integration of digital technology into the entire process of administrative emergency.But digital technology has also brought certain challenges to the administrative emergency subject,administrative emergency power,and administrative emergency process.In order to adapt to the trend of interactive development and respond to challenges,the current administrative emergency legal system needs to make changes in improving the administrative emergency subject system under the influence of digital technology,strengthening the functional positioning of personal information rights in the administrative emergency legal system,and improving the big data supervision system for comprehensive and full cycle emergency governance.
