检察官办案绩效评价基本公式研究

经过几十年的发展,检察官办案绩效评价已经具备了直观、客观、可测量的条件。从当前诸多检察业务考核指标中,可以选择几个基础性、关键性指标进行组合,形成一个专门用于测评检察官办案绩效的基本公式,以此表达检察官办案在数量、效率、责任、零差错等方面的价值追求。以基本公式为模板,还可延伸出用于评价检察官优异办案能力、检察长办案绩效的子公式。另外,为确保检察官办案绩效基本公式及其衍生子公式能得到有效应用,计算结果相对客观,具有认可度,围绕组成公式的各种要素,还需要以完善重大监督事项案件化、司法瑕疵评查、办案风险评估预警、案-件比指标体系构建等工作为重点,为要素的提取、测算提供配套机制保障。

The current performance evaluation of prosecutors in handling cases has met the conditions of being intuitive,objective,and measurable.From the current many assessment indicators for procuratorial work,basic and key indicators can be selected to form a basic formula specifically used to evaluate the performance of prosecutors in handling cases,in order to express the value pursuit of prosecutors in terms of quantity,efficiency,responsibility,zero error,and other aspects.Using the basic formula as a template,sub formulas can also be extended to evaluate the excellent case handling ability of prosecutors and the case handling performance of Prosecutor General.In addition,in order to ensure the effective application of the basic formula and its derivative formulas for the performance of prosecutors in handling cases,the calculation results are relatively objective and have recognition.Around the various elements that make up the formula,it is necessary to focus on improving the caseization of major supervision matters,judicial flaw assessment,case risk assessment and warning,and the construction of caseratio index system to provide supporting mechanisms for the extraction and calculation of elements.
