跨境电信网络诈骗犯罪取证研究——以东南亚国家为分析对象

On the Forensics of Cross-border Telecom Network Fraud Crime--Taking Southeast Asian Countries as the Object of Analysis

在当前办理跨境电信网络诈骗犯罪案件过程中,我国提取境外证据主要通过刑事司法协助途径进行委托取证,这种方式正面临我国可能与请求国没有签订刑事司法协助条约或协助条约中关于证据提取的规定不具体、请求取证程序繁琐而延误侦查时机和提取的证据不符合我国法律规定的证明标准等困境,而司法协助途径的各种替代性措施如执法机关自行取证、对第三方平台施加数据披露机制,以及通过国际组织取证等也存在各自的问题。仍应当在坚持通过刑事司法协助途径委托取证的基础上,对司法协助条约关于证据特别是电子数据提取的内容予以细化,并建立多元化的取证模式,实现对跨境电信网络诈骗犯罪的有效治理。

In the current process of handling cross-border telecom network fraud cases,China draws overseas evidence mainly through criminal judicial assistance.This approach is facing difficulties such as China may not have signed a criminal judicial assistance treaty with the requesting country or the provisions on evidence extraction in the assistance treaty are not specific,the procedure of requesting evidence collection is cumbersome,and the delayed investigation time and the evidence extracted do not meet the standards of proof stipulated in the law of China.Various alternative measures of judicial assistance,such as law enforcement agencies collecting evidence by themselves,imposing data disclosure mechanism on third-party platforms,and obtaining evidence through international organizations,also have their own problems.On the basis of insisting on entrusting and collecting evidence through criminal judicial assistance,we should refine the contents of the judicial assistance treaty on evidence,especially electronic data extraction,and establish a diversified model of evidence acquisition to achieve effective governance of cross-border telecom network fraud crime.
