互联网法院管辖的现实困境与制度完善——兼谈专门管辖的合理性

Dilemma and Systematic Perfection of Internet Court Jurisdiction:a Look at Rationality of Specialized Jurisdiction

互联网法院是司法适应信息化时代的产物,在设立初期,依靠高效的在线诉讼方式及对涉网案件的专门化审理,互联网法院基本实现了“涉网案件网上审”的目标。但随着互联网法院管辖规则的出台和在线诉讼的普及,互联网法院因定位不清暴露出了管辖范围、管辖连接点、协议管辖效力等方面的问题,也因此与普通法院产生了管辖冲突。互联网法院管辖模式亟需转型。对此,可充分利用互联网法院针对涉网案件进行审理的特点,借用专门管辖的相关规定,赋予互联网法院专门法院的定位,构建完善的专门管辖体系,并以此为基础解决互联网法院管辖所面临的各类问题,更好地发挥互联网法院在司法改革中的引领作用。

Internet court is the product of judicial adaptation to the information age.In the early days of its establishment,it basically achieved the goal of“online trial of network-related cases”by relying on efficient online litigation methods and specialized trial of network-related cases.However,with the promulgation of the jurisdiction rules of Internet courts and the popularization of online litigation,the unclear positioning of Internet courts has exposed some problems such as jurisdiction scope,jurisdiction connection points,jurisdiction effect of agreements,etc.,and thus there has been a jurisdiction conflict with ordinary courts.The jurisdiction mode of internet courts needs to be transformed urgently.In this regard,we can make full use of the characteristics of Internet courts in trying Internet-related cases,borrow the relevant provisions of special jurisdiction,endow Internet courts with the position of special courts,build a perfect special jurisdiction system,and solve all kinds of problems faced by Internet courts on this basis,so as to better play the leading role of Internet courts in judicial reform.
