Justice in the Correlational Contexts——A Politico-Philosophical Analysis Based on the Wholeness of Matters of Justice in Transitional China

转型中国正义问题的整体性,带来了'诸正义(观)间的争斗',呼唤一种'情境化的正义观',即'关联性正义'。政治社会的'正义',不能还原为道德世界的'正当'。由于现代性诉求/议程的共时性存在,以及权力主导的发展型国家的形成,转型中国的政治社会形成了以国家权力为主导的复杂关联性结构。围绕着国家权力的运行目标、运行过程及其对其他领域的支配,转型中国的正义问题至少形成了三个向度、六个方面的关联性。要把握这种关联性,我们需确立与之相对应的'关联性正义'评价法则。

The wholeness of matters of justice in transitional China, which yields the"War of(Conceptions) of Justice",calls for a "contextual conception of justice","justice in the correlational contexts" or "correlational justice". The "justice" in the political society cannot be reduced to the "rightness" in the moral world The political society in transitional China develops a complicated correlational structure, because it has a synchronic aspirations or agendas of modernity and produces a power-dominated developmental state. The matters of justice in transitional China demonstrate them at least three dimensions and six facets of correlations, revolving around the running targets and operational processes of state powers and their domination of other fields. In order to catch the correlations, we must establish the corresponding evaluative laws of"correlational justice".
