摘要
劳动合同终止是劳动合同法的重要制度之一,劳动者被宣告失踪或者宣告死亡而终止劳动合同是其规定的情形之一,然而这一规定却存在诸多疑点。本文从劳动者被人民法院宣告失踪或者宣告死亡后,可能导致劳动合同的中止及其中止期间的待遇、工伤和非工伤的认定及其相关待遇问题,提出了需要在劳动合同的司法解释和社会保险等劳动与社会保障法律法规中进行规制和完善的建议,以贯彻落实劳动合同法明确劳动合同双方当事人的权利义务,保护劳动者的合法权益,构建和发展和谐稳定的劳动关系的目的。
The annulment of labor agreement is one of the important institutions of Labor Contract Law. The declaration of disappearance or death for the annulment of labor agreement is one of the situations, but it has many doubtful points. From the angle of the condition that the declaration of the laborer's disappearance or death may result in annulment of labor agreement and the treatment during the annulment, this paper puts forward that it's necessary to normalize and perfect it in the judicial interpretation of the labor contract and in regulations of the social insurance and the social security so as to carry out the two parties' rights and obligations in the contract defined by Labor Contract Law, protect laborers' legal rights and interests, and construct and develop the harmonious and stable labor relationship.
