论体育裁判的自由裁量权

Discussion on Competition Judge's Discretion

从法官与体育裁判工作的权力运作方式、机理相似性出发,依托法官自由裁量权理论,提出体育裁判自由裁量权概念并对之进行定义。认为体育裁判享有和行使自由裁量权有其合理性,我们必须尊重;同时,为防其被滥用,我们必须对之进行控制与监督。

Based on the judicial discretion theory and the similarity of judges and competition judges exercising power, we come up with the concept of competition judge＇s discretion and define it in the study. In the study we consider it is reasonable that competition judges have and exercise discretion, so we should respect it. However, it is very likely that the competition judge＇s discretion is abused, thus power control and operative supervise are urgently needed.
