论“农民集体”之法律地位

On the legal status of"the farmers' collective"

"农民集体"作为农民集体土地所有权的权利主体,如何对其进行法律保护,历来是我国法律与公共政策的关注重点。本文首先探讨"农民集体"的概念与法律性质;其次结合集体土地所有权的归属与行使,对"农民集体"的法律地位进行静态与动态的考察,分析"农民集体"在享有与行使所有权的过程中存在的问题;最后提出对村集体经济组织进行特殊法人改造的对策建议,以保障"农民集体"与农民的权益。

As the Subject of the farmers＇ collective land ownership, how to carry on the legal protection to ＂the farmers＇ collective＂ always draws the laws and the community policies attentions. This article firstly discusses ＂the farmers＇ collective＂ concept and legal nature; secondly combining with the discussing about the owner and the exertion of the farmers＇ eolleetive land ownership, it reviews the legal status of ＂the farmers＇ collective＂ in the static and dynamic state, it also points out and analyzes the problems in the exertion of the ownership by ＂the farmers＇ collective＂ ; finally it puts forward some suggestions to transform the village collective economic organizations into special legal persons, in order to safeguard the fights of ＂the farmers＇ collective＂ and the farmers.
