摘要
国家义务是在宪法学上与公民基本权利相对应的一个基本范畴。以国家义务产生依据、体现的国家性质以及行为状态为基础,宜将国家义务划分为尊重、保护和给付三个在内容上相互关联的组成部分。按照三者履行的难易程度即"尊重、保护和给付"的顺序建构国家义务体系,既体现国家义务发展的历史规律,符合基本权利发展的精神,且对国家义务的履行具有指导和鞭策作用。
The state obligation is a basic category in the Constitution which should be in line with the fundamental rights of the citizens. The state obligation has its origin and embodies the nature of a given state and its behavior, and consists of three relevant elements： respect, protection and help. The establishment of the state obligation system according to the difficulties in their implementation helps reveal its development law and agrees with the spirit of the development of fundamental rights.
