微博“打拐”热背后的冷思考——流乞儿童权利保障的制度建构

Reflections on fad of anti-trafficking movement on microblogs:system construction for protecting vagrant and begging children's rights

2011年春节期间的微博"打拐"引发了社会公众的普遍关注与参与,这一公共事件隐藏的更深层次问题是流乞儿童权益保障问题。由于现有法律不完善、家庭和社会对儿童监护不到位以及政府资金投入不足等原因,导致流乞儿童权利保护普遍缺失。为改变这一现状,应该秉持以儿童为本的保护理念,完善现有法律制度,健全社会保障制度,建立流乞儿童管理制度和遣返制度。

In the Spring Festival of 2011,anti-child-trafficking on microblogs caught the attention and involvement all over the society,and protection of the young waifs＇ rights was reflected in this public event.This article suggests that the inadequate protection of the young waifs＇ rights results from the loopholes with the existing laws,the absence of the family and society guardianship,and the shortage of the government fund.Therefore,we should continue to uphold the child protection idea,perfect the existing legal system,improve social security,and establish the management and repatriation system of young waifs.
