我国假、劣药的政府规制现状及其问题浅析

Discussion on the Current Situations and Problems of Chinese Counterfeited & Inferior Drug Regulation

目的分析我国假、劣药政府规制的现状及问题,为完善假、劣药的规制提供建议。方法运用文献研究和数据统计的方法。结果假、劣药规制的法律法规正在不断完善,行政规制趋于缓和,刑事规制力度不断加大,多部门联动机制初步建成。但是,假、劣药定义尚不科学,行政规制资源浪费较严重,多部门联动机制不够协调,打击力度有限。结论应完善立法,科学界定假、劣药的定义,健全部门联动机制,进一步加大对假劣药的惩处力度。

Objective To analyze the current situation and problems of counterfeited ga inferior drug regulation in our nation. Methods Literature review and data statistics were used to analyze the situation and the problems. Results The legislation of counterfeited inferior drug regulation was improved; the administrative regulation became mitigated while the criminal regulation was strengthened; and the linkage system between departments was established. However, the definitions of counterfeited inferior drugs are still not clear, the administrative regulation resources are not made the best of; the linkage system is still imperfect; and the government crackdown power is limited. Conclusion The legislation should be improved; the counterfeited inferior drugs should be redefined clearly, the linkage system should be improved, and the government should impose heavier penalty on malfeasance of counterfeited inferior drugs.
