赛场体育裁判自由裁量权行使的规范化

Regulation of Umpires' Discretion in Games

随着体育运动产业化的发展,缤纷复杂的体育争议与日俱增,赛场体育裁判判罚的争议也层出不穷,而裁判判罚的争议与体育裁判行使自由裁量权息息相关。运用法理学研究方法,结合体育的特殊性,在现有体育法规则体系下,提出规制赛场体育裁判行使自由裁量权的具体原则,即裁判比例原则、均衡竞争原则和正当行为原则。一方面,以具体原则的适用弥补裁判规则的不足和缺陷;另一方面,该基本原则的适用在一定程度上矫正了CAS"赛场裁判不予审查原则"的适用。

With the development of sports industrialization, complicated disputes in sports are increasing. The disputes of umpires emerge rapidly, which are concerned with discretion of umpires. The thesis adopts the methodologies of jurisprudence, combining with specificities of sports, and proposes the fundamental principles to regulate umpires＇ discretion in sports law system. The principle of proportionality, the principle of competitive balance and the principle of good conduct, which compensate for rules applied in the games, and adjust ＂the principle of Non-review of umpires＇ decision＂ from CAS.
