摘要
美国2012年双边投资协定的范本是美国正在推进的TPP谈判的基石,中国选择启动了以准入前国民待遇和负面清单为基础的中美BIT谈判。在谈判中要充分认知与美方谈判的艰巨性和复杂性,重视和协调好国内不同管理部门的正常、正当需求和既得利益的矛盾,要注意到中美平等谈判下的不对称性,迅速加强谈判人才队伍建设,谈判的成果要有长期性和前瞻性。
The US BIT（2012） version is the blueprint of TPP negotiation. China decided to start its BIT negotiation with the US on the basis of Pre establishment national treatment and the negative list. It should be recognized that the coming negotiation would be very tough. China needs to coordinate the different needs of various domestic ministries. The conclusion for the negotiation should forward-looking.
