Yan Shu-tang's Thought about Sociological Jurisprudence

燕树棠在留美研习法律期间受到社会法学思想的影响。燕树棠坚信社会哲学派和社会学派法学将取代19世纪的分析、历史和"理学"三派而成为新的潮流。他对新学派的法律目的观、制裁观、公道观、自由观及法学研究方法诸方面进行了详细阐释,其范围已经涉及今日法社会学学科规训的大部分内容。燕树棠是西方社会法学思想在中国传播的主要推动人之一。

Yan Shu-tang contacted sociological jurisprudence when studied legal science in US. Yah contended that the legal science of social philosophy and sociological school would desplace that of analytical and historical and phisophical school which were prevalent in 19th century. Yan detailedly explained the opiou of new school about purpose of law, sanctions, justice, liberty, method of research and so on, which contained the most of sociological jurisprudence in today＇s discipline. Yan Shu-tang was one of the main person who spead sociological jurisprudence in China.
