Sino-U. S. Bilateral Investment Treaty Negotiations: International Investment and Maintenance of Overseas Interests

世界经济一体化致使国际投资成为当今趋势,中国也更加深入地融入国际社会,中国的国家利益不断向海外延伸,海外利益问题愈发凸显,如何有效维护中国的海外利益成为中国崛起和中国发展与世界关系的重大问题。国际法作为规范和调整国家间利益的重要法律形式,能够为中国海外利益的维护提供合法性依据和制度保障。本文以美国2012年双边投资协定范本为例,分析中国在中美双边投资协定谈判中面临的海外利益风险,以期为中国在国际投资中的海外利益维护提出可行路径。

International investment has become a trend with the world economic integration today. Accordingly, China also has integrated into the international society more deeply, China＇s interests extending overseas gradually and problems of overseas in- terests highlighting increasingly. Then how to maintain its overseas interests effectively becomes a major issue in the rise of China and the relationship between China and the international world. International law as an important legal form to regulate and adjust the interests between countries, it can provide an institutional guarantee and legitimacy basis for the maintenance of China＇s over- seas interests. This paper, based on the 2012 model of the bilateral investment treaty of the U. S. , analyzes its overseas inter- ests risk in Sino - US bilateral investment treaty negotiations, and puts forward a feasible path on maintenance of its overseas in- terests in the international investment, of China.
