摘要
从社会公平的角度看,劳务派遣中的同工同酬问题涉及两种公平观,即身份公平观与劳动公平观,前者体现形式公平,后者体现实质公平。不同的公平观会引致不同的行为,直接影响到同工同酬问题的解决。实现劳务派遣用工同工同酬必须坚持劳动公平观,多措并举,形成合力,通过完善同工同酬的法律规制,加强政府监管,规范企业用工管理,充分发挥工会组织的作用,切实保障被派遣劳动者的合法权益。
From the perspective of social fairness,the problem of equal pay for equal work in labor dispatch involves two fairness values,including identity fairness and labor fairness. The former is form fairness and the latter is substantial fairness. Different fairness leads to different behaviors which directly affect the solution of the problem of equal pay for equal work. The realization of equal pay for equal work in labor dispatch employment must persevere in labor fairness. To ensure dispatched laborers' legitimate rights,we need to take comprehensive measures to form resultant force by improving regulations of equal pay for equal work,strengthening government supervision,standardizing enterprise employment management and playing the role of trade unions.
