我国引入专利开放许可制度的合理性研究——以完善科技成果转化信息汇交机制为核心

On the Issue of Rationality of Patent License of Right Introducing into China: Focusing on the Improvement in Mechanism of Sci-Tech Achievements Transformation Information Collection

专利开放许可制度是促进科技成果转移转化的一项法律制度创新。我国构建专利开放许可的制度设计应对开放许可的民事合同性质、相关信息的准确与及时传达、许可声明的主体及内容、开放许可的生效、中止等作出规定。

Patent license of right is an innovation of law with respect to promoting sci-tech achievement transformation. The legal framework of patent license of right in China should include its nature of civil contract, accuracy and communication without delay of relevant information, its subject and content, its validity and termination, and so on.
