摘要
研究目的:准确界定容积率奖励制度的法律属性,提出相应的法律规制措施。研究方法:运用行政过程论的研究范式。研究结果:按照事前事中事后的逻辑顺序,可将容积率奖励制度划分为制定标准行为、作出决定行为和检查维护行为三种阶段性行为;容积率奖励制度的实施效果取决于合理的奖励标准、正当的程序规范与完善的监督保障。研究结论:(1)囿于建立在公私法二元论之上研究范式的固有缺陷,既有理论学说均无法有效揭示容积率奖励制度的本质属性;(2)制定标准行为是抽象行政行为,作出决定行为可划分成具体行政行为和行政协议,检查维护行为应定性为行政事实行为;(3)应从设定依据、内容控制、程序规范与救济渠道4个方面完善容积率奖励制度的法律规制体系。
The research purpose of this paper is to define the legal attributes of the floor area ratio award system accurately and propose the corresponding legal regulation measures.The method used is research paradigm of administrative process theory.The results show that according to the logical sequence,the floor area ratio award system can be divided into three stages : making standard behavior,decision-making behavior and checking and maintaining behavior;the implementation effect of the floor area ratio award system depends on reasonable standards,proper procedural norms and perfect supervision and protection.The conclusions are as follows: 1)due to the inherent flaws in the research paradigm based on the dualism of public and private law,the extant theories can not effectively reveal the essential attributes of the floor area ratio award system;2)making standard behavior is an abstract administrative behavior, decision-making behavior can be divided into specific administrative actions and administrative agreements,and checking and maintaining behavior should be characterized as the administrative fact;3)legal regulation system of floor area ratio award should be improved from four aspects: establishment basis,content control,procedural norms and relief channel.
