药品检验报告对假劣药认定的证据作用分析

目的明晰药品检验报告用于假劣药认定的定案证据作用。方法梳理药品检验报告作为执法和司法定案证据的法律法规、司法解释及有关政策文件,并结合假劣药认定检验的实际情况,分析药品检验报告作为定案证据的法理依据,及其在执法与司法之间的证据转化、发挥作用的注意事项。结果由药品检验机构出具的假劣药认定检验报告,不仅可依法作为查处假劣药的定案证据,而且在执法实践中还发挥着重要作用;检验报告作为司法定案证据,虽无明确的法律规定,但有充分的法理依据和实践基础提供支持;按行政执法和刑事司法衔接工作的有关要求移送案件时,检验报告可在定案证据与司法证据之间转化;经审查具有证据能力是检验报告作为定案证据的前提,这就要求药品检验机构加强检验受理评审、依法依规进行检验,并出具符合审查要求的检验报告,并在必要时出庭作证。结论药品检验机构出具的药品检验报告,在一定条件下可作为假劣药认定的定案证据,并在执法与司法实践中发挥重要作用。

Objective To clarify the final evidence role of the drug test report in the identification of counterfeit and inferior drugs.Methods By combing the laws and regulations,judicial interpretations and relevant policy documents related to drug test reports as the evidence of law enforcement and judicial decision,and combining with the actual situation of identification test of counterfeit and inferior drugs,to analyze the legal basis of drug test report as the evidence of law enforcement and judicial verdicts against counterfeit and inferior drugs,the evidence transformation of test reports between law enforcement and justice,and issues that need attention in the role of evidence.Results The test report for the identification test of counterfeit and inferior drugs issued by the drug test agency can not only be used as evidence of administrative law enforcement verdicts for investigating and dealing with counterfeit and inferior drugs,but also has been playing an important role in law enforcement practice.As the evidence of judicial verdict,although there is no clear legal provision,the test report has sufficient legal basis and a certain practical basis to provide evidence support.When a case is transferred in accordance with the relevant requirements for the execution cohesion,the test report can be used as evidence in a verdict to convert between administrative law enforcement evidence and criminal justice evidence.Having the ability of evidence after the review is the premise for the test report to be used as final evidence for the verdict,which requires the drug test agency to strengthen the acceptance and review of the test,conduct tests in accordance with laws and regulations,issue test reports that meet the review requirements,and cooperate to testify in court when necessary.Conclusion The drug test report issued by the drug test agency can be used as the final evidence for the identification of counterfeit and inferior drugs under certain conditions,and play an important role in law enforcement and judicial practice.
