摘要
为分析不同土地补偿标准对工程建设征地的影响以及现行补偿标准存在的常见问题,以梅林航电枢纽工程为例,分析区片综合地价、地方实际执行补偿地价以及同工程同地价3个方案在工程建设征地中的利弊及其影响,并提出相应的解决办法。验证结果表明,采用区片综合地价为土地补偿标准更符合国家相关法律法规的要求。另外,在确定区片综合地价时需要合理地考虑土地增值收益才能更好地保护移民的合法权益。
Theauthor analyzed the impact of different land compensation standards on land acquisition for project construction and the problems existing in the present compensation standard.Taking Meilin Navigation and Power Complex as example,the advantages,disadvantages and impact of three land price schemes including integrated land section price,local actual compensation land price and same land price for the same project were analyzed,and corresponding solutions were put forward.It was proved that integrated land section price more conforms to the requirements of relevant national laws and regulations,and it is necessary to consider the land value-added income reasonably when determining the comprehensive land price so as to protect the legal rights and interests of immi⁃grants.
