中国法学教育与研究之新蓝图——详解两办《关于加强新时代法学教育和法学理论研究的意见》

New Blueprint for Legal Education and Research in China--Deep Interpretation of“Opinions on Strengthening Legal Education and Legal Theory Research in the New Era”

中共中央办公厅、国务院办公厅《关于加强新时代法学教育和法学理论研究的意见》设定了新时代法学教育和法学理论研究的宏伟目标和施工路线,目标为二十大报告的法治中国建设。该《意见》系统总结了中国法学教育和法学理论研究领域存在的政治方向问题和管理体制问题,并梳理了法学教育体系和法学理论研究体系存在的具体问题。政治方向问题的解决方式为坚持以习近平法治思想为根本遵循,坚持和加强党的全面领导,以及加强思想政治建设。宏观横向不均衡问题的解决举措为均衡发展、政策扶持、提升质量、突出特色。宏观纵向管理指导体制问题的解决方案为遵循高等教育规律,发挥政法院校示范作用,以及打破体制机制壁垒。问题的解决最终都需要落实到法学教育和法学理论研究体系的改革和完善。

“Opinions on Strengthening Legal Education and Legal Theory Research in the New Era”(hereinafter referred to as the Opinions),which is issued by the General Office of the Communist Party of China Central Committee and The General Office of the State Council,has set the grand goals and construction routes of legal education and legal theory research in the new era,aiming at the construction of the rule of law in China reported by the Party’s 20th National Congress.The Opinions systematically summarized the political direction problems and management system problems existing in the field of legal education and legal theory research in China,and precisely sorted out the specific problems existing in the legal education system and legal theory research system.The solution to the problem of political direction is to adhere to Xi Jinping’s Thought on the Rule of Law as the fundamental guideline,to adhere to and strengthen the overall leadership of the Party,and to strengthen ideological and political construction.The solution to the problem of macro-horizontal imbalance is balanced development,policy support,quality enhancement,and outstanding characteristics.The solutions to the macro-vertical management and guidance system problems are to follow the laws of higher education,to give full play to the exemplary role of political and legal colleges and universities,and to break down the barriers of institutional mechanisms.The solutions to both the political direction problem and the macro problem ultimately need to be realized in the reform and improvement of the system of legal education and legal theory research.
