摘要
主权适用于网络空间已成为国际共识,“如何适用”的核心议题面临着否定论思潮的历史延续、填补现有规则空白的不确定性以及网络空间特殊属性等挑战。在各国共系命运共同体的背景下,有必要提出网络空间“合作主权观”,即在主权独立与自主的基础上,强调以合作为要素的主权责任,实现网络空间与主权理论的有效兼容。基于此,主权在网络空间的适用,应以促进网络空间的有序自由为共识,强化主动性以实现“保障”与“约束”的统一,增强互动性以促进“封闭”与“流动”的平衡,推动构建平等公正的网络空间国际法体系。“合作主权观”也为中国完善网络空间主权体系建设,推进独立自主的主权监管理念在国际社会的认可、应对“合法”网络攻击的安全保障危机、促进数据安全与数字发展的合作共赢等现有挑战方面提供了有益的参考。
The application of sovereignty in cyberspace has formed an international consensus,and what is how to apply faces challenges such as the historical continuation of negative ideological trend,uncertainty disputes that fill existing rule gaps,and the special attributes of cyberspace.In the context of a shared future community among all countries,it is necessary to propose an outlook on cooperative sovereignty in cyberspace,which emphasizing the sovereignty responsibility based on cooperation on the basis of sovereign independence and autonomy,and achieves effective compatibility between cyberspace and sovereignty theory.Based on this,the application of sovereignty needs to establish the consensus on orderly and free cyberspace,strengthening initiative to achieve the unity of protection and constraint,and enhancing interactivity to promote the balance between closure and mobility,which it will promote the construction of an equal and just international legal system in cyberspace.The outlook on cooperative sovereignty also provides useful references for China to improve the construction of its cyberspace sovereignty system,promote the recognition of independent sovereignty regulatory concepts in the international community,respond to the security crisis of‘legitimate’cyber attacks,and promote cooperation and win-win cooperation between data security and digital development.
