未成年女性被害人保护主体补位与协同联动

Minor Female Victim Protection Subject Complement and Collaborative Linkage

未成年女性被害人是一个更为特殊和弱势的群体,受到犯罪侵害后其身心备受摧残因而迫切需要救助与保护。本文基于社会保护理论分析框架和未成年人保护责任体系,运用文献和个案分析对未成年女性被害人的处境进行审视。在针对未成年女性被害人实施的保护行动中,家庭是与被害人关系最紧密的责任主体且发挥主要作用。当前加强和改进未成年人尤其是女性被害人保护,亟须重构保护主体补位与协同联动机制,以家庭为基础、司法为焦点、社工为枢纽,协同学校、政府、网络等多元主体,打通固有边界、链接有效资源、聚合共同责任,持续提升多元主体主动履责、协同保护的意识、能力和效果,不断健全和完善新时代未成年女性被害人社会保护体系,为未成年女性安全生活、健康成长和全面发展营造良好环境。

Juvenile female victims are a more special and vulnerable group.After being infringed by crime,their body and mind often suffer from double destruction and need to be rescued and protected.Based on the analysis framework of social protection theory and the system of minors'protection responsibility,this article uses literature and case analysis to examine the situation of minor female victims.In the protection action for underage female victims,the responsibility subject with the closest relationship between the family and the victim plays a major role.At present,to strengthen and improve the protection of minors,especially female victims,it is urgent to reconstruct the complementary and cooperative linkage mechanism of the protection subject,take the family as the basis,the judiciary as the focus,the social worker as the hub,and cooperate with multiple subjects such as schools,governments,and networks to break through the inherent boundaries,link effective resources,and aggregate common responsibilities,continuously enhance the awareness,ability,and effect of multiple subjects to actively perform their responsibilities and coordinate protection,and constantly improve and improve the social protection system of minor female victims in the new era,to create a good environment for the safe life,healthy growth and all-round development of minor women.
