加快推进生态环境修复制度法典化进程,不仅是生态环境修复制度体系化建设的现实需要,更是生态环境法典结构完整性的必然要求。推动生态环境修复制度法典化,应在全面梳理生态环境修复制度基本样态的基础上,揭示其现有法律规范难成体系、现行制度尚欠成熟等问题,在生态环境修复制度体系化构造的基础上逐步完成法典化的转化,最终形成生态环境法典总则编中生态环境修复制度基本定义条款、法权配置条款、核心措施条款、与其他制度相衔接的规范表达,以及生态环境法典分则编中生态环境修复制度污染防治编、自然生态保护编、法律责任编的规范构建思路。
