档案监督检查执法依据研究:现行体系、问题及完善路径

Research on the Basis of Law Enforcement of Archival Supervision and Inspection:the Existing System,Problems and Improvement Path

档案监督检查工作的执法依据已形成体系,并在其多层级体系动态调整和完善中实现对档案监督检查执法的制度供给,有效指导实践。然而,其依然存在条款更新不及时,法规配套不平衡,立法协调与衔接不够等情况。据此,可从立法角度对其做进一步完善:适当消减配套以凸显必要性,健全多层级结构以提升有效性,丰富立法形式以增强立法效率。

The law enforcement basis of archival supervision and inspection has formed a system,and in the dynamic adjustment and improvement of its multi-level system,the institutional supply of law enforcement of archival supervision and inspection is realized,and the practice is effectively guided.However,there are still some conditions such as clauses are not updated in time,matching of laws and regulations is unbalanced,and legislation coordination and convergence is not enough.Based on this,the law enforcement basis system for archival supervision and inspection can be further improved from the legislative point of view:appropriately cut the support to reflect the necessity,improve the multi-tier structure to enhance effectiveness,and enrich legislative forms to enhance legislative efficiency.
