以中国话语在生态环境法典中确认环境权

Conforming Environmental Rights in Ecology and Environment Code with Chinese Language

编纂生态环境法典作为重大政治任务和立法任务,已列入全国人大常委会2024年年度工作计划。通过法典编纂,将党的十八大以来生态文明建设理论、制度、实践成果以法典的形式确认下来,适应新时代我国社会主要矛盾新变化,回应人民群众对美好生态环境的新期盼,是生态环境法典编纂的目标和方向。在生态环境法典编纂研究中,我们要以习近平新时代中国特色社会主义思想特别是习近平生态文明思想和习近平法治思想为指引,坚持人民立场,认真对待生态环境新期盼带来的利益关系新变化;坚持改革开放,准确把握我国环境权益保护现状与政策取向;坚持道路自信,以中国话语在生态环境法典中确认环境权并作出一般规定、建立相应的保障制度和救济制度,提升中国生态环境治理体系与治理能力现代化水平,提供加强全球生态环境治理的中国方案。

As a major political and legislative task,compiling an ecology and environment code has been included in the annual work plan of the Standing Committee of the National People's Congress in 2024.Through the work,the goal and direction of compiling an ecology and environment code is to confirm the theoretical,institutional and practical achievements of ecological civilization construction since the 18th CPC National Congress in the form of codification,adapt to the new changes in the main contradictions of the Chinese society in the new era,and respond to people's new expectations for better ecology and environment.In the research of compiling an ecology and environment code,we should be guided by the Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era,especially the Xi Jinping Thought on Ecological Civilization and the Xi Jinping Thought on the Rule of Law,adhere to people's position,take seriously the new changes in the interest relations brought about by the new expectations of ecology and environment,adhere to reform and opening up,accurately grasp the current situation and policy orientation of China's environmental rights and interests,and adhere to confidence in the path.We should also affirm the environmental rights and make general provisions in the ecology and environment code with Chinese language,establish corresponding protection and relief systems,upgrade the modernization level of China's ecological and environmental governance system and governance capacity,and provide Chinese solutions for strengthening global ecological and environmental governance.
