Discussion on Convicting the Crime of Manufacturing or Selling Counterfeit or In ferior Quality Drugs

目的 :正确判断生产、销售假劣药品行为的罪与非罪以及与其他有关犯罪行为的区别。方法 :运用犯罪构成理论进行分析。结果与结论 :应对生产、销售假劣药品罪的主体、客体、主观要件和客观要件作具体分析 ;关键是主观要件和客观要件 ,主观上均为间接故意 ,客观上生产、销售假药罪为危险犯 ,生产。

OBJECTIVE:To ascertain whether a conduct of manufacturing or sellin g counterfeit drugs or drugs of inferior quality commits a crime,and to distinqui sh between such crimes and other certain crimes METHODS:Applying the methods o f theory on constitution of crime RESULTS & CONCLUSION:We should analyse the subject,object,subjective and objective aspects of such crimes in detail;the critical points are the subjective and objective aspects,i e the offenders al l have indirect intentions,and the crime of manufacturing or selling counterfei t drugs is perilous offence while the crime of manufacturing or selling drugs of inferior quality is injurious offence
