浅论非人身伤亡基金的设立

Research on the Establishment of Funds for Non-Personal Claims

重大海损事故责任人依法可以享受责任限制,但同时要设立赔偿责任基金,我国有关法律没有明确责任人是否一定要同时设立人身伤亡基金和非人身伤亡基金,文章指出,责任人要同时设立人身伤亡基金和非人身伤亡基金,并提出对我国海商法的修改意见。

The person responsible for maritime claims is entitled to the limitation of the liability. To establish funds for such limitation is a necessity. There is no provision in CMC that such person should establish funds for claims for loss of life or personal injury and for other claims at the meantime. This paper offers suggestion to the amendment to the CMC.
