数据财产法益保护主要分为权利保护模式与行为规制模式。行为规制模式的优势主要在于对公共利益目标的满足能力、对不确定处境的应对能力以及渐进有效凝聚社会共识和稳定制度预期的能力。由此,行为规制模式与权利保护模式形成了相互竞争、配合以及嵌套的复杂关系。当前,数据财产法益保护宜慎重采取权利化方案而优先考虑行为规制模式。充分发挥行为规制模式的优势,需要关注局部明确或“共向模糊”的社会共识、数据行业不明朗的巨大效益和制度激励需求、规制工具的应用和成熟等前提条件是否满足。
