地方政府劳资集体争议的调解策略及其影响因素——基于北京市案例的扎根研究

The Mediation Strategies of Labor-Management Collective Disputes and Its Determinants in Local Government: Cases Research in Beijing

我国频发的劳资集体争议引起了学术界和实务界的广泛关注,调解是地方政府处理这一争议的重要方式。基于北京市的案例,采用扎根理论的研究方法,深入分析了地方政府劳资集体争议的调解策略及其影响因素。研究发现地方政府的调解策略主要包括程序策略、情理策略、评估策略、借力策略和分化策略,调解的情境(包括争议的特点和争议双方的特点)会影响调解策略的选择;调解的情境通过影响地方政府调解代理人对争议和解难度和目标导向的综合评估,进而影响调解策略的选择;调解代理人所在机构的类型影响其综合评估后的策略选择。在此基础上,文章提出了地方政府调解劳资集体争议的对策建议。

The frequent labor-management collective disputes in China have aroused wide attention in academia and practical circle.Mediation is an important way for local governments to deal with labor-management collective disputes.This paper uses the grounded theory method to analyze labor-management collective dispute mediation strategy and its determinants based on the cases in Beijing.The results show that mediation strategies in local government include following ways as the procedures,sentiment,evaluation,assistance and disintegration strategies.In addition,the context of mediation(including the characteristics of the dispute and both parties)will affect the choices of the strategies.The context of mediation influences the choice of mediation strategy by influencing the comprehensive evaluation of the difficulty and goal-orientation of dispute settlement made by the mediation agent of local government.The type of mediation agent influences the choices of the strategies after comprehensive evaluation.Based on these results,the paper proposes the suggestions for mediating labor-management collective disputes.
