我国社会团体登记管理工作现状及展望——基于对《社会团体登记管理条例》实施效果评估的分析

The Current Development Situation and Prospect of Registration and Administration on China’s Social Associations From the Perspective of Evaluation of the Enforcement Effect on Registration and Administration Regulations of Social Associations

1998年由国务院制定的《社会团体登记管理条例》是我国社会团体登记管理的重要行政法规,为社会团体登记管理发展提供了基本制度遵循。随着我国国家治理体系和治理能力现代化目标的提出,十八大以来各项改革实践的深入推进和外部发展环境的不断变化,社会团体登记管理工作呈现出新的发展趋势,亟待从立法方面予以回应。本文基于对《社会团体登记管理条例》实施效果评估的分析,深入分析了我国现行登记管理制度的现状及不足,在此基础上提出"十四五"规划时期完善立法的基本构想。

The Registration and Administration Regulations of Social Associations formulated by the State Council in 1998 is an important administrative regulation in China,which provides the basic system for the registration and administration of the Social Associations.With the proposal of aiming for modernization of the national governance system and governance capacity,the deepening of reform practice since the 18th CPC National Congress,and the continuous changes in the external development environment,the registration and administration of the Social Organizations presents new trend of development,which needs to be responded by legislation.From the perspective of the evaluation of the effect of law enforcement of Regulation on the Registration and Administration of the Social Associations,this paper analyzes the current situation and shortcomings of registration and administration system in China,and puts forward the basic idea of perfecting the legislation.
