通过司法数据的考察可知,非法吸收公众存款罪案件近年呈现高发态势明显、入罪率高、涉案主体以民营企业为主等特点。该罪的司法现状与当下加强民营企业产权保护的呼声以及宽松的政策、法律环境相悖。规范层面上入罪标准模糊、现实层面上民营企业融资的困境成为该罪高发的原因。对该罪构成要件限制性解释以提供合理的司法出罪路径,不仅契合当下刑事政策转型的需要,更对促进社会就业、助力经济转型具有十分重要的意义。

Based on the empirical investigation of judicial documents,it shows a high number of cases of the crime of illegally absorbing public deposits in recent years,a high rate of conviction,and large number of private enterprises committing the crime.The judicial status of the crime of illegally absorbing public deposits is contrary to the current call for strengthening the protection of property rights of private enterprises and the loose policy and legal environment.On the normative level,the standard of entering the crime is vague;and on the practical level,the financing dilemma of private enterprises has become the reason for the high incidence of the crime of illegally absorbing public deposits.The restrictive interpretation of the constitutive elements of the crime to provide a reasonable judicial way out of the crime is not only in line with the needs of the current criminal policy transformation,but also of great significance to promote social employment and economic transformation.
