若要深入探讨权利与善的优先性之争,其首要任务就在于发现该问题的实质与核心。权利与善的优先性问题无非是在寻找这两者形成的来源和依据,以此说明何者更为根本或具有基础性。权利与善并非处于彼此对立的两端,所谓的“中间道路”自始就是难以成立的,其甚或会对该优先性问题造成倒逼与激化。社群主义不足以从根本上对自由主义构成颠覆或挑战,其尚不具备站在自由主义对立面的条件和能力。在权利与善的优先性问题上,社群主义者与自由主义者反倒有某种程度的共识与默契。权利与善的优先性问题是在理论层面展开的,但其终归还要体现出高度的实践性特征,从而更好地服务于法治建设。

For exploring the priority dispute about right and good in depth,the primary task is to find the essence and core of the problem.The priority problem about right and good is nothing more than looking for the source and basis for the formation of both,to explain which is more fundamental or basic.Right and good are not at the opposite ends of each other,and the so-called“middle road”is difficult to set up from the beginning,which may even confuse and intensify the priority problem.Communitarianism is not enough to fundamentally subvert or challenge liberalism,as well as not having the condition and competency to stand on the opposite of liberalism.As far as the priority problem about right and good is concerned,there is a certain degree of consensus and understanding between communitarians and liberals.The priority problem about right and good is carried out at the theoretical level,but it will reflect a high degree of practical characteristics ultimately,so as to better serve the rule of law.
