信息化背景下,大数据分析成为法律监督的重要手段之一。检察大数据监督是实现检察资源最大化利用、提升检察机关整体办案能力水平和工作质效的现实需要。运用大数据开展法律监督是检察机关破解监督瓶颈、优化监督流程、重塑监督模式的一项重大变革,也是新时代实现法律监督质效飞跃的关键变量。得益于数字检察战略的实施,检察机关在法律监督领域的大数据运用进入高速发展期,相关探索实践取得了令人瞩目的成效,但在理念、机制、路径等方面仍暴露出问题和不足,有必要从理念更新、顶层设计、体系协同等维度开展对策研究,从业务逻辑、思路拓展、建模方法等方面重点建构大数据分析在法律监督中应用的具体路径和长效机制,为大数据法律监督的深化发展提供解决方案。

In the context of informatization,big data analysis has become one of the important means of legal supervision.Procuratorial big data supervision is a practical need to maximize the use of procuratorial resources and improve the overall case-handling ability and quality and efficiency of procuratorial organs.Using big data in legal supervision is a major innovation for cracking supervision bottleneck,optimizing supervision process,reshaping supervision mode of the people’s procuratorate.It’s also a major strategy of high quality development of procuratorial work in the new era.Thanks to the implementation of the digital procuratorial strategy,the use of big data in the field of legal supervision has entered a period of rapid development,relevant explorations and practices have achieved remarkable results.However,problems and deficiencies are still exposed in terms of concepts,mechanisms,and paths.It is necessary to carry out countermeasure research from the dimensions of concept updating,top-level design,and system collaboration,and focus on constructing specific paths and long-term mechanisms for the application of big data analysis in legal supervision from the aspects of business logic,idea expansion,and modeling methods,so as to provide solutions for the deepening and development of big data legal supervision.
