融合履职视野下的生态环境检察

The Eco-environmental Procuratorial Work under the Perspective of Integrated Performance of Duties

建立生态环境检察公益诉讼制度的本质是重构生态环境检察职能,形成“始终坚持用最严格制度最严密法治保护生态环境”的检察工作合力。但实践中存在着“四大检察”发展不平衡、一体履职的工作机制尚未真正建立等问题。生态环境案件所呈现的“人—自然—人”法律关系特征以及生态环境公益诉讼的特殊性对融合履职提出了迫切的现实需求,在现行三大诉讼分立体制以及相关理论无力妥善解决生态环境领域公益检察相关问题的情况下,必须通过理论创新促进制度创新,构建融合履职的生态环境检察制度,为实现“人与自然和谐共生的现代化”贡献检察智慧和力量。

The essence of establishing the eco-environmental public interest litigation by procuratorate is to restructure the function of eco-environmental procuratorial work,and form the resultant force of procuratorial work in“always adhering to the strictest system and the most rigorous rule of law to protect the eco-environment”.However,there are some problems in practice,such as the imbalanced development of the four major procuratorial work and the lack of a real integrated work mechanism.The characteristics of the“human-nature-human”legal relationship in eco-environmental cases and the particularity of eco-environmental public interest litigation have put forward an urgent realistic demand for integrated performance of duties.Under the circumstance that the current three separate litigation systems and relevant theories are unable to properly solve the problem of public interest litigation by procuratorate in the field of eco-environment,it is necessary to promote institutional innovation through theoretical innovation,and build an eco-environmental procuratorial system that integrates multiple procuratorial work,contributing procuratorial wisdom and strength to realize“the modernization of harmony between humanity and nature”.
