帮助信息网络犯罪活动罪的独立性与依附性

The Independence and Subordination of the Crime of Helping Information Cybercrime

帮助信息网络犯罪活动罪作为刑法新增罪名,具有独立的犯罪构成。但不能否定,帮助行为正犯化后具有了独立化立法属性的同时,其作为帮助行为的自然属性依然存在,帮助信息网络犯罪活动罪的成立不能绝对独立地脱离于被帮助对象。司法实践中,应当同时把握帮助信息网络犯罪活动罪的独立性和依附性,通过“情节严重”的入罪门槛强调依附性和帮助属性对本罪独立性外延的限缩,关注被帮助对象是否实际利用了帮助行为产生的作用力,不能仅基于违法数量的叠加而将帮助违法行为径直入罪,且应允许对本罪“积量构罪”推定规则的反证。

The crime of helping information cybercrime,as a new independent crime in the criminal law,has an independent criminal constitution.However,it cannot be denied that the crime’s natural attribute as a help act still exists.In judicial practice,we should grasp the independence and dependence of the crime of helping information cybercrime at the same time,emphasize the limitation of the independence of this crime by“serious circumstances”,and pay attention to whether the assisted object has actually used the force generated by the help behavior.We should not directly criminalize the help illegal behavior based on the superposition of the number of violations,and we should allow the counter evidence of the presumption rule of“volume constitutes crime”of this crime.
