平台数据垄断现象引致反垄断监管的必要性,但平台数据垄断在保护竞争与提高效率、维护消费者利益和维护社会公共利益三方面都有特殊性,影响到反垄断监管限度的设置。基于数据规模利益、供给优化窗口和合理分享空间三种特殊因素,建议不对单纯的数据集中实施反垄断监管,不将数据集中作为审查经营者集中的额外考虑因素;对持续优化供给成本及质量的平台垄断者可以延迟填补消费者剩余;如果将平台数据作为必要设施分享或开放,则应设置一定时间限制,力求将反垄断监管控制在合理边界之内。

The phenomenon of platform data monopoly leads to the necessity of anti-monopoly supervision,but platform data monopoly has particularities in protecting competition and improving efficiency,as well as protecting consumer interests and safeguarding social public interests.This affects the setting of the limits of anti-monopoly supervision.Based on the three special factors of data scale benefits,supply optimization window and reasonable sharing space,it is recommended that anti-monopoly supervision should not be implemented in simple data collections,and data collections should not be recognized as an additional consideration for reviewing business concentrations.Platform monopolists who continuously optimize the cost and quality of supply can delay the filling of consumers’surplus.If platform data are shared or opened as a necessary facility,a certain time limit should be set to strive to control anti-monopoly supervision within reasonable boundaries.
