Algorithmic Paradigm Shift and its Legal Readiness under the Common Prosperity Policy

算法决策有如一双“看不见的手”,已经结构性嵌入社会资源的调配层面,支撑着共同富裕政策的稳步推进。与此同时,因应双循环新发展格局的科技使命转型、创新场域扩展、竞争样态优化和产业格局调整也深刻重构了算法决策的范式流程。数据处理的全新样态击穿了传统算法规制的静态防御屏障,催生了方案构建目标安全、关系扩张技术安全、平台交互数据安全的动态法律需求。充分把握算法范式升维的“融贯特性”,未来制度构建应着力普惠“涉众”而非“受众”,关注数据“化合过程”而非特定“运算结果”,并提前防范技术的“反向遮蔽”和“集置锁定”。为确保新规范的有效性,具体规则设计还需与时偕行,维持法律瑕疵补正和技术风险趋势间的合比例匹配。

Like an invisible hand,algorithmic decision has permeated into the resources allocation layer of modern society,serving as catalyst for the national policy of Common Prosperity.In turn,the mission transformation of science and technology,expansion of innovation field,optimization of competition and adjustment of industrial structure brought by the development pattern where domestic and foreign markets can boost each other with the domestic market as the mainstay also deeply reconstructed the paradigm of algorithmic decision.The new business mode of model dis-embedding,isomorphism of different sources,parallel decision-making and pre-negotiation had broken through the existing legal infrastructure hence call for a new three-layer security structure,with the target safety of scheme-making being the first layer,technological safety of relationship-expansion being the second layer and data safety of platform-interaction being the third layer.Fully grasping the coherent characteristics of the algorithmic paradigm shift,future policy-making should focus more on stake-holders instead of targeted individuals,pay more attention to the security of data-merging process instead of the outcome accuracy,and by-all-means avoid potential technology dislodgement and Ge-stell lockdown.To ensure the effectiveness of future legislation,the specific institutional arrangements need to keep pace with the time so as to achieve a dynamic matching between the defects-repairing of the legal rules and the constant varying trend of the emerging risks.
