监察调查留置措施“逆向介入”的规范适用

监察调查与刑事司法程序存在衔接上的先后顺序,留置措施根据介入时间节点的不同存在“顺向适用”与“逆向介入”两种类型。在权威高效行使监察权的前提下,如何协调留置措施“逆向介入”与刑事司法程序的运行是需要正视的重要问题。“侦查—调查”作为非典型的程序承接,需要进一步理顺监察权与司法权、监察调查与刑事司法程序、监察权威与司法公正、权力行使与权利保障之间的关系,通过体系审视与价值优化的理念引导,理性对待留置“逆向介入”给刑事司法程序带来的实践挑战,统筹考量监察调查与司法运行之间的关系。结合刑事司法程序的不同阶段进行细致梳理并化解可能带来的程序阻滞,遵循“法法衔接”的精神内核并确保权力运行的协调性,一体考量监察调查与刑事司法程序并使之尽可能并行不悖,理应成为监察调查“逆向介入”之下规范适用的应然选择。

There is a sequential order of connection between supervisory investigation and criminal procedure.According to the different timing of intervention,there are two types of the detention measures:"in-sequence application"and"reverse intervention".On the premise of the authoritative and efficient exercise of supervision power,how to achieve the coordination between the"reverse intervention"of the detention measure and the operation of criminal judicial procedure is an important issue that needs attention.For"the transition from judicial investigation to supervisory investigation"as an atypical procedural connection,it is necessary to further sort out the relationships between supervisory power and judicial power,supervisory investigation and criminal procedure,supervisory authority and judicial impartiality,power exercise and right protection,and to rationally deal with the practical challenges brought by the"reverse intervention"of supervisory detention to criminal procedure through the philosophy guidance of system examination and value optimization,and comprehensively consider the relationship between supervisory investigation and judicial operation.It should be the natural choice for the normative application of"reverse intervention"of supervisory investigation to carefully sort out and resolve possible procedural barriers in different stages of criminal procedure,comply with the principled core of the"connection between supervision law and criminal procedural law"and ensure the coordination of power operation,and consider the supervisory investigation and criminal procedure as a whole and make them operate as parallel as possible.
