市场有效自律、政府有为监管与社会有机共治:电商高质量发展中的监管模式及其运作机制研究

摘要 电商高质量发展离不开市场监管的“保驾护航”。那么,电商的高质量发展需要怎样的市场监管理论模式?监管模式有效运行的机制是什么?这是亟待学界与实务界回答的问题。本文解析了电商高质量发展的内涵与目标,探讨了电商高质量发展与市场监管的关系,还分析了目前主流的监管模式及其不足。为此,本文立足“有效市场、有为政府和有机社会”三大理论概念,构建了契合电商高质量发展的新监管理论模式——“市场有效自律、政府有为监管与社会有机共治”。文章进一步以江苏省S市电商高质量发展的优秀监管经验为例进行解析。研究发现:电商市场主体通过诚信合规、品牌建设、共享监管信息等机制实现市场有效自律合规;监管部门采取信用监管、数字化监管、协同监管机制,同时不断提升监管服务与制度保障,达成政府有为监管;社会力量凭借订立电商“村规民约”、专业协会监管、动员培育消费者参与等机制,完成社会有机参与共治。市场、政府与社会三股监管力量互为依托、有效衔接,形成强大的监管合力,助推电商高质量发展。这些认识,为推动电商高质量发展中的监管理论发展与监管模式优化提供了一定的参考。 The high-quality development of e-commerce depends on effective market regulation.What kind of market regulatory model is required for the high-quality development of e-commerce,and what mechanisms ensure the regulatory model operates effectively?These questions are critical for both academics and practitioners.The article examines the essence and objectives of the high-quality development of e-commerce,explores the relationship between such development and market regulation,and assesses the strengths and weaknesses of current mainstream regulatory models.Based on the theoretical concepts of“efficient market”,“proactive government”and“organic society”,the research establishes a novel regulatory model tailored to the high-quality development of e-commerce:“effective market self-discipline,proactive government regulation,and organic social governance.”Additionally,the article analyzes the successful regulatory practices in the highquality development of e-commerce in City S,Jiangsu Province.The study reveals that e-commerce market entities achieve market self-discipline and compliance through mechanisms such as integrity and compliance,brand building,and the regulatory information shaving.Regulatory authorities employ credit regulation,digital regulation,and collaborative supervision mechanisms,continually improving regulatory services and institutional assurances to achieve proactive government regulation.Social forces contribute to organic social participation and governance through initiatives such as formulating“village rules and agreements”for e-commerce,professional associations supervision,and mobilizing and cultivating consumer involvement.The interconnected and well-coordinated regulatory efforts of market,government,and society form a powerful collaborative force that propels the high-quality development of e-commerce.These insights serve as a valuable reference for advancing regulatory theory and optimizing regulatory models in the pursuit of high-quality e-commerce development.
