摘要
欧共体1968年《布鲁塞尔公约》第5条第1款是针对有关合同事项的特别管辖权所做的规定。自公约生效至今,该条款无论在理论界,抑或在司法实践中,均引起诸多争议。对此,本文着力分析了适用该条款的利弊,认为这一规定在很大程度上减弱了公约第2条作为管辖权基本原则的效力,亦不利于公约目的的实现,明显弊大于利,应予以废止。同时,本文还进一步探讨了废止该条款后可能出现的情况及所应采取的相应补救措施。
Article 5(1)of the 1968 Brussels Convention is the provision about the special jurisdiction on the matters relating to a contract.Since the Convention came into force,there has been a huge controversy over this clause in theoretical and practical field.The author pays much attention to analyzing the merits and demerits of it,and holds that this clause derogates from the primary principle of general jurisdiction,i.e.Art.2 of the Convention,fails to satisfy the general objective of the Convention as well.Obviously,the demerits outweigh the merits,therefore it is benefical to abrogate them.Furthermore,the author also gives attention to the remedy for abrogating it.
