我国法律博士专业学位设置的必要性和可行性

自1995年批准设置法律硕士专业学位至今,法律硕士专业学位授权点数量和授予学位人数稳步上升,已成为我国法学研究生教育体系的重要组成部分。为建设高素质法治工作者队伍,有必要提高法律专业学位的培养规格,探索设置法律博士专业学位;为完善我国法学学科体系,有必要明确法律博士的培养目标;为深化法律专业学位研究生教育改革,有必要实现法律博士的分类培养。符合专业博士学位设置基本条件的现有法律硕士的培养基础、法律硕士专业学位培养的经验总结、部分院校开展法律博士专业学位的设置试点、法律博士专业学位设置基本原则的探索确定,可为设置法律博士专业学位提供可行性基础。

With more and more programs and holders,the Juris Master degree has become an important part of the graduate education system in China since 1995.In order to cultivate the high-quality legal talents,improve the legal graduate education system,and deepen the reform of legal professional degrees,it is necessary to improve the training level of graduate students in law,explore the establishment of Juris Doctor degrees and clarify their training objectives and achieve classification training.The existing development circumstance in line with the basic conditions for establishing Juris Doctor degree,summarizing the development experience of Juris Master degree,and setting up some trial programs for Juris Doctor in some universities and deciding the basic principles of establishing Juris Doctor degree can provide a basis for the Juris Doctor degree in China.
