集体建设用地入市的制度效应——兼论农村集体产权改革

摘要 鉴于财产权利束中的各项权能相互关联,本文关注集体建设用地入市对农村集体产权保护和实施的影响。在理性人假设下,本文构建的理论模型试图解释,集体建设用地入市的许可能够提升农村集体建设用地的市场价值,这让保护这种资产或者产权的激励更足。从产权排他的属性上来说,产权的强度也会得到提升。结合中国目前推进的集体产权改革,集体经济组织成员之间的交易成本会降低,这对集体产权的保护将更加有利。 This paper focus on the effects of collectively-owned construction land entering the land market basis on the protection and enforcement of the rural collective property rights,on the basis of the connection of functions in the bundle of property rights.The authors construct the model to explain that the collectivelyowned construction land entering market could enhance the incentive to protect the property rights,due to it improved the market value of the rural collective property rights.Moreover,it would enhance the strength of property rights from the view of exclusivity of property rights.It will see the reduction of the transaction costs between the members of collective organization in the context of reform of the rural collective property rights system.
